Common questions about property law
How long does a typical residential conveyance take?
Most residential purchases in Ireland complete within six to ten weeks from the date contracts are signed. Delays usually arise from mortgage drawdown conditions, outstanding planning queries, or title defects that require rectification before closing. We set realistic timelines at the outset and keep you informed if anything changes.
What is the difference between registered and unregistered title?
Registered title is recorded on a folio at the Property Registration Authority and is guaranteed by the State. Unregistered title relies on a chain of title deeds going back at least fifteen years. We handle both systems, though compulsory first registration now applies to most transactions, so unregistered titles are gradually being brought onto the register.
Can I transfer my property to a family member without selling it?
Yes. A voluntary transfer by deed is common between family members. However, stamp duty applies at the current rate on the market value, and the recipient may face Capital Acquisitions Tax if the value exceeds their lifetime threshold. We coordinate with your tax adviser to structure the transfer efficiently.
